ABC Board Shutters Calera Package Store
Alabama Alcoholic Beverage Control Board today notified the owners of R & R
Wine and Liquor LLC, located in Calera, Alabama, that selling alcohol through a
“drive-up” window is a violation of state law and that they must close the
drive-through window immediately. ABC
Agents hand delivered the closure letter to owners Beau Rourke and Robert
Rourke this morning.
Rules and Regulations 20-X-6-.01(9) do allow a “walk-up” window, but only for
off-premises beer and/or table wine licensees. R & R Wine and Liquor LLC is
a package store that sells distilled spirits and is licensed for that purpose.
Package store licensees are prohibited from operating “drive-through” and
“walk-up” windows, and require customers to exit their vehicle to allow for
observation by the sales clerk. This provides an opportunity to judge the
sobriety, as well as the age of the customer.
law does allow the holder of an off-premises beer and/or table wine license to
sell beer and/or table wine through a “walk-up” window only if all other goods
of the licensee are available for sale and the remainder of the premises is
closed to the general public. An example would be convenience stores located in
high-crime areas that sell merchandise through a security window. Otherwise, state law requires all sales of
alcoholic beverages to be made on the inside of the premises.
& R Wine and Liquor must immediately cease all “drive-up” operations and
remove all signage by Monday, February 17, 2014, or its license will be subject
to review and disciplinary action by the ABC Board.
